Terms of Service and End User License Agreement

1. Agreement to Terms and Corporate Entity

By accessing or using the NeuraScene application ("the Service"), you agree to be bound by these Terms of Service. The Service is operated by Informationist Pty Ltd. If you do not agree with any of these terms, you are explicitly prohibited from using or accessing this site. Informationist Pty Ltd merely provides the neutral technological tools for generative AI; we do not endorse, facilitate, or authorize any specific user generations.

2. Zero Tolerance Acceptable Use Policy

You agree that you will not use NeuraScene to generate, prompt, or distribute content that is illegal, harmful, or violates the rights of others. This includes an explicit and zero-tolerance ban on:

• Deepfakes and Non-Consensual Representations: Creating realistic representations (images, audio, or video) of real people without their explicit, documented consent.
• Non-Consensual Sexual Content (NCSC): Generating sexually explicit material or nudes depicting real people, particularly in the context of abuse or harassment.
• Defamation and Harassment: Generating content designed to defame, harass, or inflict emotional distress upon individuals or groups.
• Intellectual Property Infringement: Using prompts, reference images, or generating outputs that infringe upon the copyrights, trademarks, or other intellectual property rights of third parties.

Violation of this policy will result in immediate termination of your account without notice, and we reserve the right to report illegal activities to law enforcement.

3. User Responsibility, Authorization Liability, and Indemnification

You, the user, are solely responsible for the content you generate.

Because Informationist Pty Ltd is an Australian entity, we do not rely on statutory Safe Harbour laws to protect us from user behavior. Instead, by using this Service, you explicitly acknowledge and agree that:

• Informationist Pty Ltd does not authorize, endorse, or approve any specific content generated by users.
• You warrant that you have the necessary rights to all input materials and prompts you use.
• Indemnification: You agree to fully indemnify, defend, and hold harmless Informationist Pty Ltd, its directors, employees, and agents from any and all claims, lawsuits, damages, and financial liabilities arising from your use of the Service, including but not limited to claims of copyright infringement, defamation, or creation of illegal content.

4. Notice and Takedown System

Informationist Pty Ltd acts responsibly to prevent abuse. If you believe that content generated via NeuraScene infringes your rights, is defamatory, or violates our Zero Tolerance policy, please report it immediately.

Upon receiving a valid notice, Informationist Pty Ltd reserves the right to rapidly investigate, remove the offending content, and permanently ban the responsible user.

5. Disclaimer and Limitation of Liability

The Service and materials on NeuraScene are provided on an 'as is' basis. Informationist Pty Ltd makes no warranties, expressed or implied, regarding the output of the generative AI.

In no event shall Informationist Pty Ltd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, business interruption, or legal liability from outputs) arising out of the use or inability to use the Service. Your sole remedy for dissatisfaction is to stop using the Service.

6. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts in New South Wales for the resolution of any disputes arising under these Terms.
